Queensland Property Disclosure Laws: What Has Changed Under the Property Law Act 2023?

Queensland's property disclosure laws have been fundamentally reformed. Seller disclosure obligations in Queensland are now governed by the Property Law Act 2023 (Qld) (PLA 2023), which commenced on 1 August 2025, replacing the previous regime under the Property Law Act 1974 (Qld).
Whether you are selling a freehold lot, a community title lot, or a proposed lot off-the-plan, the new Queensland seller disclosure framework is demanding.  A failure to disclose, or an inaccurate disclosure, can entitle the buyer to terminate the contract and recover any deposit paid.

What Does Queensland Law Require Sellers to Disclose? | Seller Disclosure Obligations Explained

Queensland law requires sellers to give buyers a completed Disclosure Statement in the approved form, together with all relevant prescribed certificates, before - or at the time of - signing the contract of sale.  The information provided in the Queensland seller Disclosure Statement must be accurate at the time it is given to the buyer.

Seller Disclosure Statements and prescribed certificates for Queensland property sales can be prepared, signed, and delivered electronically - a practical option for sellers given that many Queensland property contracts are signed outside of business hours.

The prescribed certificates required under the Property Law Regulation 2024 (Qld) cover a range of topics including: encumbrances and title matters, land use and zoning, planning and environment, buildings and structures, rates and utility services, and — for properties in community title schemes — body corporate information and disclosure.

What Happens if a Seller Fails to Comply with Queensland Disclosure Obligations?

Under section 104 of the Property Law Act 2023 (Qld), a buyer may terminate the contract of sale if the seller fails to provide the required Disclosure Statement, fails to attach all prescribed certificates, or makes an inaccurate disclosure.  On termination, the seller must repay all amounts already paid by the buyer, including the deposit.

This is not a risk any Queensland seller can afford to take.  A qualified Queensland property solicitor can help you ensure your disclosure is complete, accurate, and fully compliant before the contract is signed.

Why Choose Agility Law Group as Your Queensland Property Solicitors?

Preparing a compliant Queensland seller disclosure package under the Property Law Act 2023 (Qld) and the Property Law Regulation 2024 (Qld) is not a tick-box exercise. It requires expert legal knowledge, careful attention to detail, and sound commercial judgment.

  • A thorough understanding of the current law — including the prescribed certificate requirements under the Regulation and, where applicable, the additional obligations under the Land Sales Act 1984 (Qld) for off-the-plan contracts.

  • Careful attention to accuracy — the disclosure statement must reflect information that is true at the time it is given. Errors can be costly.

  • Sound commercial judgment — knowing which exceptions may apply and how to structure the transaction to protect your position.

At Agility Law Group, you work directly with highly qualified, experienced property solicitors — not paralegals, not automated systems.  We bring deep expertise, personal attention, and the care your transaction deserves.
